  7. नॉर्थ म्यूनिसिपल कार्पोरेशन दिल्ली के अंदर प्रत्येक हेरिटेज बिल्डिंग जोकि नोटिफिएड हेरिटेज सूची में है और वह शाहजहांबाद इंवैंट्री ऑफ हेरिटेज -1 में उस बिल्डिंग की फोटोग्राफ है और बिल्डिंग का विवरण जैसे Plan Form, Height, Transformation Conditions-Plan, Elevations, Walls, Plinth Decoration Walls, Windows, Columns, Entablature, Brackets, Chajjas, Balcony Railings, है इन सबको तोड़कर नई बिल्डिंग बनाने के लिए HCC या उत्तरी दिल्ली नगर निगम दोनों या किसी एक से अनुमति लेना जरूरी है या बिना अनुमति लिए भी बिल्डिंग को तोड़कर नयी बिल्डिंग बना सकते है लिखित में जानकारी दी जाए ।

  1. Please provide us information as whether N.D.M.C. has lately submitted their plans to you for your approval regarding restoration/renovation for Gole Market Heritage Central Structure as has been declared as a Heritage Building Under Grade `A`.

  1. Whether the said properties against whom the abovesaid Writ petitions have been filed for unauthorized constructions without any sanctioned from the MCD are situated in declared Heritage Area, or not, if yes at what Serial No and the area of the said Serial no. of the Heritage Area.
  2. Whether no objection for the construction is required from the Heritage Department is required or not. If yes, whether any no objection has been issued to the MCD or any other person for the construction of the said properties.
  3. As to from which year the Heritage Law has been enforced?
  4. Whether the Delhi Development Authority has any concern with the said Properties or the Heritage Buildings of the above said area, under the United Building Byelaws for Delhi-2016, which Law has been enforced by the DDA?
  5. If any person of Bhagirath Palace situated in the Heritage Area, makes any unauthorized construction can be taken by this Department of Heritage. Whether any FIR can be lodged for the same and who is the competent Authority to lodge such complaints with the concerned Police Station and further whether any FIR has been lodged by the Heritage concerned office with any Police Station, if yes, I may be supplied the particulars of the complaints by providing the copies thereof and the details of the FIRS etc. and the names of the persons against whom the said F.I.Rs have been lodged.
  6. Whether the abovesaid unauthorized constructions made by the respective various owners/occupiers in their properties in Bhagirath Palace in the Heritage Department, can be demolished or the same can be regularized under any provisions of the Building Bye-laws. I may be provided the copy of such bye-law under which the same can be regularized.

  1. Rules and norms for declaring a building as heritage building.
  2. Does declaring a building as heritage one affects the rights of the property owner mentioning also if central or state government gets some special rights on the building declared as heritage building ?

  1. Whether the adjoining properties which were owned by the different owners from Ground to Foutth Floors etc. including Property No.1853 which is owned by the Trust Bissomal Gaindawati in Bissomal Colony of Bhagirath Palace etc. are also situated in the Heritage Department or not.
  2. Whether the unauthorized constructions made in the various properties in the said Area and the Bissomal Colony of Bhagirath Place and the abovesaid Properties and the sealing orders passed by the MCD, are in the knowledge of your Department or not. If yes I may be supplied the details of such properties and the details of the unauthorized construction and sealing orders and the action by your Department thereon.
  3. Whether any FIR has been lodged by your Department for the said unauthorized constructions in the various properties in Bhagirath Palace by the various owners/occupants.
  4. Whether any permission to reconstruct, or raise any construction was applied for by any of the owners/occupiers of the properties of the said Area of Bhagirath Place or not. If yes I may be supplied the details of such applications and the action taken thereon.
  5. Whether any property situaed in bhagirath palace under Seal No.68, can be constructed by getting the sanctioned plan and by seeking permission from your Department, if yes, I may be supplied the provisions of the law under whidl the same can be constructed and plan can be sanctioned and what kind of construction, residential or commercial can be raised. I may also be supplied the copy of the prescribed application form, the fees required to be paid and the documents required to be submitted to your department for seeking the permission for raising construction in the properties situated in the said Bhagirath Palace Delhi area.

The applicant requested for an urgent survey of property No.1237, 1238, 1239, 1240, 1241, 1242, 1243, 1244,1245, 1246, and 1272 Vakilpura Chah Rahat Jama Masjid Delhi 110006, dated 22.02.2023 for appropriate action/survey Please attested copy of the survey conducted with a timestamp and GPS camera Supply interior and exterior photos taken.
  2. From which departments the survey team was selected, please supply the detailed information of those officers’ names, designations, departments, etc.
  3. Supply information on distance from other heritage/ancient properties in the vicinity of these sites and impact on other ancient properties.
  4. Supply heritage and historical facts and events associated with these sites.
  5. Since No.1237 and 1472 Vakilpura, Chah Rahat, Jama Masjid, Delhi 110006 both have been permitted/approved to be demolished and constructed as Showroom/Shops/Business Complex/Godown or Factory, please supply a copy of the same.
  6. 1244-1247 While demolishing Chah Rahat, their mythological signs were visible, so supply mythological information related to them.
  7. Also supply information on the analysis of foreign revenue gains from heritage properties.

  1. Whether the properties situated in the Heritage List in Grade II and III, including the abovesaid property which is situated in Grade III, can be regularized by the MCD, without the consent and permission of the Heritage Department.
  2. If the same can be regularized by the MCD without the consent and permission of Heritage Department, the provisions of the various law under which the MCD can regularize the same.
  3. If the MCD regularises the abovesaid properties without the consent and permission of the Heritage Department, what action can be taken against the erring officers of the MCD.
  4. Whether the MCD can regularize the said unauthorized construction or it is trying to mislead the Hon’ble court stating that the said property has been totally changed and there is no sign of heritage in the said unauthorized construction, while the fact is that there are still, the signs of the heritage building are still present in the building at the site.
  5. If the owner of a Property which is situated in Heritage Department gets the plan sanctioned for additions, alterations or new construction, whether the prior permission or no objection is required from your Department for approving the said sanctioned plan or the MCD can directly approve the same without the permission and consent of the Heritage Department.
  6. If a property situated in Heritage List in IInd and IIIrd grade collapsed automatically, what is the procedure to get the same reconstructed and under which law the same can be reconstructed. I may be provided the details of the said law and the procedure.

I may be supplied the following information regarding Property No.1248, Serial No.62, Delhi Heritage Department Hakim MIhr Ali Shah’s Mosque, Kacha Bagh, Chandni Chowk, Delhi-6, which is situated in the Grade II of the Heritage List of the Govt. of India as has also been confirmed by your office is the List of Grade II at Serial No.62, of Gazette Notification vide No. F.No.7(367)/227/2002/UD/841 dated 25.02.2010 as a heritage property.

  1. What is procedure for making constructions, additions, alterations, renovations and development of the Property in the Grade II of the Property of Commercial Nature mentioned in the Heritage List, I may be supplied the rules and regulations in this respect.
  2. Whether the construction in the abovesaid property No.1248, situated at Hakim MIhr Ali Shah’s Mosque, Kacha Bagh, Chandni Chowk, Delhi has been made under the rules and regulations of the Heritage Department.
  3. Whether any permission for raising the said construction in the abovesaid property has been obtained by the owner from your Department.
  4. If the said construction have been made without the permission of Heritage Department, and further the Govt. and has also be encroached upon and included in the abovesaid Mosque, what action can be taken by your Department or the Local Bodies. I may be supplied the names and full addresses of the Local Bodies who are competent to take action.
  5. What action has been taken by your Department on my complaint already submitted to your office and the other Local bodies for the said unauthorized construction and encroachment made in the said property.
  6. Whether any information has been made by the Local Bodies about the unauthorized construction and illegal encroachment of the abovesaid property to your office, if yes I may be supplied the copy of such information letter(s) and the action thereon.

  1. Please let me know when and on what basis the Travancore House, New Delhi, was classified as Heritage Building.
  2. Please let me know when was it notified as Heritage Building and furnish me the copy of the Notification if any.
  3. Please provide me details about the person or body of persons who submitted a Report/Request to classify “Travancore House” as Heritage Building.
  4. Please provide me copies of all documents, which formed the basis for Travancore House, New Delhi, to be classified as Heritage Building.
  5. Please let me know as to, why the ownership of Travancore House is mentioned as “Public” and what are the supporting documents for such claim and furnish me copies of those documents at my cost and expenses.

The whole of Bhagirath Place, Chandni Chowk, Delhi, area with byelane presently Ward No.74 is a Heritage declared area by the Heritage Department at Serial No.68 of the List of the Heritage Buildings in Heritage Zone vide their letter No.47(58)/2015/HCC dated 10th November, 2015 sent to me under RTI Act 2005. The copy of the said letter is annexed herewith for your information.

The said building bearing Property Nos. 1849 to 1853 (Ground to Fourth Floor and adjoining area, got fire recently and some of the properties including the Property bearing No.1849 to 1853, Bhagirath Palace and the adjoining properties, were damaged completely.

I have come to know that some owners/landlords/occupants/tenants want to re-erect the building at the said site and the Malba is being removed from the site.

I may be supplied the following information:-

  1. Whether the said property can be re-erected without the No Objection issued by your Heritage Department. If yes, I may be supplied the copies of the rules and regulations in this respect if any.
  2. Whether the owners/landlords occupiers have any right to raise the unauthorized construction without getting the sanctioned plan and without no objection from Heritage Department, what action can be taken and the said action can be taken by the Heritage Department or the Local Bodies.
  3. Whether any landlord/tenant/occupier/owner has applied for the “No Objection” from the Heritage Department for re-erection of the building and the adjoining areas damages in the abovesaid fir. If yes, I may be supplied the copy of the said ap[placation and the documents filed alongwith the same.
  4. If the landlords/tenant/occupier/owner have the right to re-erect the said building, what is the procedure for getting the No Objection and whether No Objection can be issued on certain conditions. If there are any such conditions, I may be supplied the copy of the said conditions.
  5. Whether for issue of No Objection by your office, the No objection from the Delhi Fire Service for reconstruction is required by your office before issuing the NOC.
  6. If the No Objection is issued for re-erection of the building in place of the fire damaged property, upto which level the construction can be raised. I may be supplied the rules and regulations in this respect and whether the said No Objection can be issued under the MPD 2021 or MPD 2041.

The property bearing No.1238 Kacha Bagh, Chandni Chowk, Delhi-6 i.e. PROPERTY KNOWN AS HAKIM MIHR ALI SHAH’S MASJID, is a Heritage Building at Serial No.62 of List of the Heritage Buildings.

Some builders/unauthorized persons after demolition of some part of Ground floor of the said Masjid have started the unauthorized construction from Ground to Second floor therein without getting the plan sanctioned from the MCD or your Department.

I may be supplied the following information:-

  1. Whether any permission has been granted for the reconstruction of the Masjid and the construction at the site is going on with your permission and after getting the sanctioned plan and the construction is being made under the knowledge of your office. I may be supplied the copy of the permission letter, if any issued by your office.
  2. Whether the said property is situated in Heritage Buildings, if yes, in which Category.
  3. If a property is situated in heritage Department, upto which distance no construction can be raised by any person. I may be supplied the copy of such rules and regulations in this respect.
  4. If the said property is being constructed and raised unauthorisedly, whether the complaint can be lodged to the Police Station concerned by your office or by the MCD Officials for taking action against the said unauthorized construction and against the unauthorized Builders.

  1. उपरोक्त प्रॉपर्टी हेरिटेज बिल्डिंग / हवेली न० 944 मलिवारा चाँदनी चौक दिल्ली के बारे में सबूत सहित लिखित में जानकारी दी जाए कि HCC के रेकॉर्ड के मुताबिक ये पूरी प्रॉपर्टी / हवेली हेरिटेज है या इस प्रॉपर्टी का केवल गाते / दरवाजे हेरिटेज हैं ।
